11th Circuit Court Rejects Schiavo Appeal

PINELLAS PARK, Fla. - With time running out for Terri Schiavo, a federal appeals court Wednesday rejected her parents’ latest attempt to get the brain-damaged woman’s feeding tube reconnected.
The Atlanta-based 11th U.S. Circuit Court of Appeals agreed to consider an emergency bid by Bob and Mary Schindler for a new hearing in their case, raising a flicker of hope for the parents after a series of setbacks in the case. But the court rejected the request 15 hours later.
Three times last week, the court also ruled against the Schindlers.
“Any further action by our court or the district court would be improper,” Judge Stanley F. Birch Jr. wrote. “While the members of her family and the members of Congress have acted in a way that is both fervent and sincere, the time has come for dispassionate discharge of duty.”
Something struck me as interesting about that last paragraph. I want to read the whole decision before I get more specific, but I’m pretty pissed off right now. I just want to make sure I have my ducks in a row before I blow up about this one.

The Man Hater still blaming Michael for everything? What she fails to see is the so called “blame” lies on her and everyone else that has allowed the laws that are enforced to not impinge upon his decision as a spouse.
The country’s not even split on this issue were you to put it to a consensus. The conservative are split though, as you can see on most of the right blogs.

Yes, curse you, Michael, for the eating disorder that led to a potassium imbalance that led to cardiac arrest that led to five minutes without oxygen in the brain, at which point, were it not for extraordinary medical efforts, Terri would have been “gone” fifteen years ago. It’s all your terrible, awful fault, Michael.

As for the two Man-Haters - you’re blame is so misplaced. You blame Michael the entire time when it’s the judicial system that’s in disagreement with you.
The courts have upheld YOUR laws so really - you’re as much a guilty party as the next.
Right now, we’re just playing monday morning quarterback.

I would suggest to “just a child” to consult his/her parents, grandparents, uncles, aunts etc. instead of asking advice or help from strangers on the internet.
That’s if just a child is really just a child to begin with.

IF, that is indeed a child. I don’t think it is. As for being a man hater, say what you want. What I blame Michael for is being such an ass towards his in-laws. Why hold on to Terri when he has his “mistress” and that is exactally what Jodi is. He could have let Terri go way before he began his relationship. Then none of this would be going on right now. Her parents would have custody of her and she would be taken care of right now instead of being starved for almost 2 weeks. If you think what he did is right then, oh well!!!

It is plain and simple, If he only would have divorced her, annulled it or filed a disolution. That is no soap opera. Things would have ended there, no courts, govenors or Presidents involved. Just the family, like so many say it should have been this time. I totally agree there too, It should have been the family to make the decisions for Terri since there was no living will. Is it too much to ask that Michael could involve the feelings of Terri’s parents? You do realize this is a bit more complicated than that, don’t you?

Michael is her family. If your stating that a blood meber of a family should have more say than a spouse you’re opening up a whole new can of worms. Just because you’ve had bad experiences with significant others doesn’t mean others have. I, for one, would trust my wife’s judgement far more than my parents.

The courts would never have ordered Terri’s death had Michael not petitioned for it to begin with, because Florida law clearly states that if there is no written directive then it is presumed the patient would want to live. Michael is the one that initially petitioned to have Terri die - the courts sided with him for some reason or another.
And don’t label me a man-hater. I don’t just hate men. I am an equal opportunity hater. Give me the opportunity and I’ll hate you as much as the next person.

This has played a big part in my skepticism regarding the logic (and lawfulness) behind Michael Schavio’s appointment as Terri’s guardian. Requests to investigate a possible criminal act were denied time and again.
I think aspects such as the mysterious bone scan results added to Michael’s extramarital activities justify doubts demonstrated by those with perspectives similar to those of Kathy and Kricket.
It’s true that the burden of proof lies on the accusers. But the Schindlers have not been granted the proper freedom nor the public tools to pursue the proof they need to show the courts.

Gordon, there have been many a time I have offered to take a pitchfork to ignorant women as well. But see, you don’t know me from the next person so it is easy for you to label me a man-hater.
I don’t have a problem with the law. As I said, Florida law is very clear about erring on the side of life when it comes to not having end of life wishes written down. What I have a problem with is the total disregard of that law by the husband and the judges. And yes, there ARE laws that I have a problem with. Actually there are quite a few. Just because it is a law doesnt mean I have to agree with it, like it, or even follow it, although that would likely end up with me in jail and I have children to raise so for now I try to follow the law and if I’m that against it I can try to change it. In my home town, I am currently doing that for my children. It’s not a life and death situation like Terri’s, but there are things going on in the county I live in that are unfair for the children, even to the point of violating their first admendment rights. So I have been out there writing letters and talking to people. In the meantime though, my children have to follow this ‘law’ (more a rule than anything at the momemt) until I can get it changed.
I vent my anger on so many people, I can’t hardly count them all. I have been ranting at home about the soulless bastards that have kidnapped, raped, and murdered the girls this past week that are just a year or two younger than my own daughter. I am totally for taking a pitchfork and/or worse to them. But being on the strike, I am trying to keep my posts relevant to Terri. Give it time and I’ll be back to being pissed off at every one equally.
I do ’see the trees for the forest’. But you need to read all my words in context of each other instead of taking the parts you want and making them mean something totally different to fit your preconceived view of me.
